The San Jose Sharks (from Winnipeg) have forfeited the 1st overall pick in the 2008 Prospect Draft to the Toronto Maple Leafs. Since this is a first offense, San Jose will be awarded the 2nd overall pick by default.
In accordance with Yahoo fair play and sportsmanship rules:
4) No owner will make any roster moves (including waiver claims, trade proposals, etc.) whose sole purpose is to hamper the play of other owners.
5) No owner will take any action whose purpose is to, in any way, interfere with fair play in a league.

As exhibited, the San Jose sharks disregarded a number of rules and by-laws in its Week 23 matchup versus the Toronto Maple Leafs. In doing so, the intentional benching of players in order to obtain the 1st overall prospect pick (acquired from Winnipeg) violated Yahoo rule #4 which states:
No owner will make any roster moves (including waiver claims, trade proposals, etc.) whose sole purpose is to hamper the play of other owners.
As well as Yahoo rule #5:
No owner will take any action whose purpose is to, in any way, interfere with fair play in a league.
The intentional benching of players is included in the clause “ANY roster moves whose sole purpose is to hamper the play of other owners” and as a result, the “fair play” of the league has been interrupted as stated in rule #5. The “hampering” comes in the form of stripping Toronto of its equal opportunity to obtain the 1st overall prospect pick in the 2008 draft by benching players and essentially “throwing” the week thus altering the points in the standings.
The benching of the players was not only premeditated but was intentional and not “accidental” as proved by the PM sent via NAFHL forum and the transactions on the Yahoo league page. Nine different players spent time on the bench during the 23rd week of play, Daniel Cleary was added, Sidney Crosby was activated, so there was activity and awareness of the situation.
The PM served via the NAFHL forum exhibits premeditation and malice aforethought. In acknowledging “A’ight fair enough,” this shows compliance, acknowledgment the act was “wrong,” and understanding that it was not to be done.
In disregarding these requests, Section 11 of the NAFHL rulebook has also been “violated” and could escalate into further consequence if not regulated.

So say at the end of the year, I have top spot secured and I'm facing Toronto. I now have Winnipeg's 1st round prospect pick and say he's a few points ahead of Toronto. Can I then lay down and let Toronto walk over me to gain 1st overall in the draft? Technically this doesn't hurt my team because I'd already have first place secured and it'd help me in the future with the pick.
This is a tough one, but I think I have decided within the rules that are in play now, what you are explaining would not be allowed. Regardless of your place in the standings it is equally unfair to Toronto for you to completely "throw" the week to obtain first pick in the draft. Technically this isnt any different than Winnipeg throwing the week to obtain first pick. At this point it isnt about helping or hurting your team, its about what is fair for the rest of the league, specifically the bottom two teams. The only exception to the rule of "so long as it helps your team" is draft pick altering. I think this falls into that category.
